1Malaysia Development Berhad (1MDB) and its subsidiaries agreed on August 13, 2026, to discontinue a US$5.64 billion civil suit against former CFO Radhi Mohamad by recording a consent order in court [1, 2, 3]. Under the consent order, the suit was discontinued with no liberty to file afresh against Radhi, who is 55 years old [1, 2, 3].

The suit was originally filed on May 7, 2021, by 1MDB and four of its subsidiaries: 1MDB Energy Holdings Ltd, 1MDB Energy Ltd, 1MDB Energy (Langat) Ltd, and Global Diversified Investment Company Ltd (formerly 1MDB Global Investments Ltd) [1, 2, 3]. It named seven defendants, including former prime minister Datuk Seri Najib Razak, former finance director Terrence Geh Choh Heng, former executive director Casey Tang Keng Chee, former chief investment officer Vincent Beng Huat Koh, Radhi Mohamad, former investment director Kelvin Tan Kay Jim, and former chief investment officer Nik Faisal Ariff Kamil [1, 2, 3].

The civil suit alleged breach of trust, breach of statutory duty, abuse of power, and conspiracy to misappropriate 1MDB funds [1, 2, 3].

High Court Judicial Commissioner Mohamad Redzuan Idrus struck Radhi Mohamad out as a co-defendant on August 13, 2026, following the consent order. The judge thanked all parties for their efforts to settle the matter [1, 2, 3]. Counsel Lee Shih for the plaintiffs confirmed: "My Lord, I can confirm that the plaintiffs and the sixth defendant would like to record a consent judgment or consent order today. Under the consent order, the suit against Radhi would be discontinued, with no liberty to file afresh" [1].

The trial entered its eighth day on August 13, 2026, with three witnesses for the plaintiffs having testified, including former 1MDB CEO Datuk Shahrol Azral Ibrahim Halmi, who read his witness statement that afternoon [1, 2, 3]. The trial is scheduled to resume on Monday, August 17, 2026 [1, 2, 3].
