The FIA International Court of Appeal confirmed its decision to reinstate penalties against Alpine's Pierre Gasly at the 2026 Monaco Grand Prix, demoting him from third to seventh place [1, 2]. The ruling came after McLaren and Red Bull appealed a previous reversal that had restored Gasly's podium finish [1, 3, 2, 4].

Gasly’s penalties originated from two five-second penalties for pit lane speeding during the race in June, initially dropping him to seventh [4]. Alpine's appeal temporarily returned him to third, ahead of McLaren's Oscar Piastri and Red Bull's Isack Hadjar, who moved to fourth and third respectively after the final court decision [2, 4].

Following the Court of Appeal release on September 4, former team boss Flavio Briatore accused judge Filippo Marchino of bias linked to McLaren. Briatore alleged Marchino had inappropriate connections stemming from attending a 2018 McLaren event and the One Drop Foundation, which he claimed received "two or three McLaren cars" [1, 2, 4]. Briatore said, "One of the judges act like a prosecutor. This is not a big problem. The problem is he's very linked with the McLaren company" [1]. He admitted his team did not raise concerns during the initial hearing as they only discovered the alleged links afterward [1].

The FIA Court of Appeal responded on September 5, refuting these claims and affirming the independence and impartiality of its judges. The court said, "No objection was raised during the hearing concerning the manner in which the court questioned the witness or conducted the proceedings. The court is confident in the soundness of the proceedings and the integrity of the judges" [3].

McLaren team principal Andrea Stella called Briatore's accusations "insulting" and said Briatore would have to take responsibility for his remarks. Stella added, "I find that this conference is going in this direction, quite insulting for McLaren, for the reputation of a team that deserves a lot of respect" [2].

The FIA Court of Appeal's statement marks the official end of the dispute over Gasly’s Monaco result. The demotion to seventh stands as the final position in the championship standings after the 2026 Monaco Grand Prix [1, 2].
